Uniform Support Affadavit

In any circuit court proceeding involving spousal support or child support, each party is required to complete and file a Uniform Support Affidavit. If a party is seeking pre-judgment temporary support order or seeking a post-judgment support modification order, a Uniform Support Affidavit is required to be filed at the time that the motion is filed. When completing the income portions of this form, use quarterly or yearly averages where appropriate. Do not base your income on an unduly high or low paycheck. You also need to recognize bonuses, overtime, commissions, and other sources of income historically earned. When completing the expenses portions of the form, you also should use quarterly and annual averages. The numbers for day care expenses and out-of-pocket insurance premiums for the children are especially important. Regarding day care, be sure to calculate an annual amount including summer and school holidays, and then divide by twelve. Regarding health insurance premiums, the amount is the "out-of-pocket" cost for the children. This is defined as the difference between the premium with the children in question and the premium without the children in question. The amount is not determined by dividing the premium by the number of total family members. You may add footnotes to explain any of the numbers on the form. Please also include the documentation that is required to be filed with the Affidavit.

This Affidavit almost certainly will be admitted into evidence, so complete it accurately and fully. You likely will be cross examined on it.

Please note that a special, more limited, version of the Uniform Support Affidavit is required in administrative proceedings.
